Ryan T. McCoy

Mr. McCoy’s practice encompasses various types of employment litigation, including wage and hour class action, discrimination, wrongful termination, and retaliation matters, as well as commercial litigation and complex insurance coverage. Mr. McCoy represents clients across a broad spectrum of industries, including transportation, warehousing and order fulfillment, retail, insurance, and pharmaceuticals. Mr. McCoy has experience in all aspects of litigation, from pretrial matters, to second chair jury trial experience, to state court appeals.

Experience

  • Arbitrations before the American Arbitration Association in numerous matters including claims for wage and hour violations, sexual harassment, pregnancy discrimination, disability discrimination, and meal and rest period violations.
  • Successfully enforced an arbitration agreement’s class action waiver in numerous state court actions for national truck rental retailer.
  • Successfully defended against an ADA class action brought against a national truck rental retailer through the enforcement of a national class action settlement agreement (negotiated by prior counsel).
  • Successfully prosecuted Talent Agency Act controversy before the California Labor Commissioner on behalf of a television actor who was defrauded by his agent.
  • Second chaired the defense of a bad faith jury trial to nominal damages in Los Angeles Superior Court.
  • Defended national life insurance company in multiple bad faith actions, one of which resulted in a published opinion in the California Court of Appeal on novel issue of whether interpleader of life insurance proceeds is appropriate where sole beneficiary is the “prime suspect” in the insured’s murder [Farmers New World Life Insurance Company v. Rees (2013) 219 Cal.App.4th 307].
